Order to Craft Jurisdictional Discovery Plan Not an Appealable "Final Decision"

On Friday, September 30, 2005 the D.C. Circuit held that a District Court's order requiring the parties to confer and propose a jurisdictional discovery plan was not a "final decision" of that court and thus was not appealable under 28 U.S.C. ยง 1291. The court, therefore, dismissed the appeal for lack of jurisdiction.
